In-N-Out Pro Painting (“we,” or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (the “Mobile Messaging Terms”). The Program and our collection and use of your personal information are also subject to our Privacy Policy. By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

Program Description

We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include promotions, specials, and other marketing offers. Transactional messages relate to existing or ongoing service-related activity, such as appointment confirmations, project updates, service notifications, or follow-ups.

Mobile messages may be sent using automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 20 messages per month.

You agree that we, our affiliates, and any third-party service providers may send you messages regarding the preceding topics or any related topic and that such messages and/or calls may be made using different telephone numbers or shortcodes.

We do not charge for mobile messages sent through the Program, but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for SMS or MMS alerts.

User Opt-In

By providing your mobile phone number to us, you are voluntarily opting into the Program and agree to receive recurring mobile messages from us at the number provided, even if it is registered on any state or federal “Do Not Call” list.

You confirm that the mobile number you provide is valid and that you are the owner or authorized user. If your number changes or you are no longer the authorized user, you agree to notify us promptly at:

User Opt-Out and Support

You may continue to receive messages briefly while your request is processed, including a one-time confirmation message.

Note: Our system may not recognize variations of opt-out commands. We are not responsible for requests that do not follow the specified format.

We may change the phone number or shortcode used to operate the Program and will notify you if that occurs. Messages sent to outdated numbers may not be received, and we are not responsible for those requests.

Disclaimer of Warranty and Liability

The Program is provided on an “as-is” basis and may not be available in all areas or at all times. We are not liable for delayed, failed, or misdirected message delivery.

Modifications

We reserve the right to modify or cancel the Program or these Mobile Messaging Terms at any time. Any updates will take effect once posted on our website.
